PicPlanr Terms of Service

These Terms of Service govern your access to and use of PicPlanr, including our website, content planning tools, artificial intelligence features, social media integrations and related services.

1. About PicPlanr
PicPlanr is a content planning and social media management platform designed to help businesses, creators and individuals organise images, analyse content, generate caption suggestions, create content ideas, build publishing schedules and connect supported third-party accounts.
Some features use artificial intelligence to analyse information and produce suggestions. Artificial intelligence output may occasionally be incomplete, inaccurate or unsuitable. You are responsible for reviewing all captions, recommendations, schedules and other generated content before using or publishing it.
PicPlanr does not guarantee specific levels of engagement, enquiries, sales, followers or business growth.
2. Account eligibility
You must be at least 18 years old and legally capable of entering into a contract to create an account.
You must provide accurate and current information and keep your login details secure. You are responsible for activity carried out through your account unless it results from a security failure caused by PicPlanr.
You must notify us promptly if you believe your account has been accessed without permission.
3. Free trial
PicPlanr may provide a one-time free trial.
The trial may allow you to experience account setup, website analysis, image analysis, caption generation, content ideas and a preview of the Smart calendar.
The trial does not include live social media publishing, saving a publishing queue or other features marked as requiring a paid subscription.
Each customer, business or workspace may use the trial only once. We may prevent duplicate trial accounts or abuse of the trial system.
No payment will be taken unless you actively select a paid subscription and complete checkout.
4. Subscription plans
PicPlanr offers subscription plans including Starter, Business and Pro.
The price, included allowances and available features for each plan are displayed before checkout. Plan limits may include:
images analysed
website analyses
scheduled posts
connected social accounts
team members
other usage-based features
Your subscription begins when payment is confirmed and renews automatically at the billing interval shown during checkout unless cancelled.
We may change our plans or prices in the future. Existing customers will receive reasonable notice before a price change applies to a future renewal.
5. Payments and billing
Payments are processed by Stripe or another payment provider shown during checkout. PicPlanr does not directly store full payment card details.
You authorise the payment provider to charge the applicable subscription fee and any taxes due.
If payment fails, we may retry payment, restrict paid features or suspend the subscription until payment is completed.
You remain responsible for charges incurred before cancellation takes effect.
6. Cancellation
You can cancel a paid subscription through the billing area of your PicPlanr account.
Cancellation prevents future renewals. Unless otherwise required by law, access to paid features will normally continue until the end of the current paid billing period.
Deleting your PicPlanr account is separate from cancelling a subscription. Where account deletion is requested, PicPlanr will also attempt to cancel the associated active subscription.
Nothing in these Terms limits any cancellation or refund right that cannot legally be excluded.
7. Refunds
Subscription fees are generally non-refundable once a billing period has started, except where:
the law requires a refund
you have been charged incorrectly
PicPlanr has agreed to provide one
the service has materially failed to conform to the contract and the issue cannot reasonably be corrected

8. Usage limits
Each plan includes defined monthly allowances.
Usage may be counted when PicPlanr begins or successfully completes a paid service, including an image analysis, website analysis or scheduled publishing action.
When a limit is reached, PicPlanr may block further use of that feature until:
the allowance resets
you upgrade your plan
you purchase an additional allowance, where offered
Unused allowances do not roll over unless expressly stated.
9. User content
You retain ownership of the images, videos, captions, branding, documents and other material you upload to PicPlanr.
You grant PicPlanr a limited licence to host, copy, process, analyse, resize, transmit and display that content only as reasonably required to provide the service.
You confirm that:
you own the content or have permission to use it
the content does not infringe another person’s copyright, trade mark, privacy or other rights
you have the necessary authority to publish it
it does not contain unlawful, fraudulent, abusive or harmful material
PicPlanr may remove content or restrict an account where we reasonably believe these Terms or the law have been breached.
10. Artificial intelligence features
PicPlanr may use artificial intelligence service providers to analyse websites, images, account information and user instructions, and to generate captions, recommendations and content ideas.
Generated content is provided as a suggestion, not professional, legal, financial or marketing advice.
You must review generated content before publishing it. You are responsible for checking:
accuracy
spelling and grammar
claims about products or services
copyright and trade mark issues
advertising compliance
suitability for your audience
compliance with each social media platform’s rules
PicPlanr is not responsible for losses caused by publishing content without appropriate review.
11. Website analysis
Where you provide a website address, PicPlanr may access publicly available pages to understand the business, services, brand voice and content opportunities.
You confirm that you are authorised to request analysis of that website.
Website analysis may not capture every page or may be affected by website restrictions, outdated information or inaccessible content. You should review the resulting business profile and correct any inaccuracies.
A saved analysis may be reused to improve future content without performing another website scan.
12. Social media connections
PicPlanr may allow you to connect third-party services such as Instagram, LinkedIn, TikTok or Google Calendar.
You must have authority to connect and manage each account.
By connecting an account, you authorise PicPlanr to perform the actions clearly shown during the connection and publishing process, which may include:
reading basic account information
displaying profile details
retrieving authorised performance information
creating or publishing approved content
checking publishing status
synchronising scheduled content
PicPlanr will not intentionally publish content without a clear user action or approval.
Third-party platforms may change their systems, permissions, policies or availability. PicPlanr cannot guarantee uninterrupted access to any third-party integration.
You must comply with the terms and policies of each connected platform.
13. Publishing responsibility
Before publishing, you must check the selected account, media, caption, date and time.
PicPlanr is not responsible where content is published to the wrong account or with incorrect information because the user approved incorrect publishing details.
Publishing may fail because of expired permissions, platform outages, unsupported media, account restrictions or third-party technical errors.
PicPlanr will aim to show a clear success, processing, failure or reconnect status where possible.
A scheduled post is not guaranteed to publish until the connected platform confirms successful publication.
14. Prohibited use
You must not use PicPlanr to:
break any law or regulation
infringe intellectual property or privacy rights
impersonate another person or business
publish misleading, fraudulent or deceptive content
distribute malware, spam or harmful code
interfere with PicPlanr’s security or operation
attempt to access another customer’s workspace
reverse engineer or copy protected parts of the service
bypass plan limits or create duplicate accounts to obtain repeated trials
use the service for harassment, hate, exploitation or illegal activity
15. Availability and changes
We aim to keep PicPlanr available and reliable, but we do not guarantee uninterrupted or error-free access.
We may temporarily suspend parts of the service for maintenance, security, updates or matters outside our reasonable control.
We may improve, replace or discontinue features. Where a material change significantly affects a paid subscription, we will provide reasonable notice where practical.
16. Intellectual property
PicPlanr and its associated software, design, branding, workflows, databases and documentation are owned by or licensed to [legal company name].
These Terms do not transfer ownership of PicPlanr to you.
You may use the service only for your own legitimate business or personal content activities and only while your account remains authorised.

18. Account suspension and termination
You may stop using PicPlanr at any time.
We may suspend or terminate an account where:
payment remains overdue
the account creates a security risk
the service is used unlawfully
these Terms are materially or repeatedly breached
required by a court, regulator or platform provider
Where appropriate, we will provide notice and an opportunity to correct the issue.
19. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.
Subject to those rights, PicPlanr is not responsible for:
indirect or consequential loss
loss of profit, revenue, goodwill or business opportunity
social media reach or engagement results
actions taken by connected third-party platforms
loss caused by user-approved content
outages or changes to third-party services
content or data lost because the user failed to maintain appropriate copies
Where legally permitted, PicPlanr’s total liability relating to the service will not exceed the amount you paid to PicPlanr during the 12 months before the event giving rise to the claim.
20. Business users
If you use PicPlanr on behalf of a company or organisation, you confirm that you have authority to bind that organisation to these Terms.
Where you are acting wholly or mainly for business purposes, consumer-only rights may not apply.
21. Changes to these Terms
We may update these Terms to reflect changes to the service, law, security requirements or third-party integrations.
The latest version will be published on this page with an updated date.
Where a change materially affects an active paid subscription, we will provide reasonable notice before it takes effect where practical.
22. Governing law
These Terms are governed by the laws of Scotland.
The courts of Scotland will have jurisdiction, except where applicable consumer law gives you the right to bring proceedings in another part of the United Kingdom.
